Terms of Service

These Terms of Service ("Terms") govern your access to and use of Claymore.one ("Service"), a session replay and analytics platform. By using the Service, you agree to be bound by these Terms.

Important: Paddle.com Market Limited ("Paddle") acts as our Merchant of Record for all payment transactions. When you purchase a subscription, Paddle processes your payment and is the seller of record. Paddle's terms of service and privacy policy also apply to your purchase.

1. Acceptance of Terms

By accessing or using Claymore.one, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

2. Description of Service

Claymore.one provides a software-as-a-service (SaaS) platform for:

  • Session replay recording and playback
  • User behavior analytics and heatmaps
  • Conversion tracking and attribution
  • Console and error logging
  • AI-powered session analysis

The Service is provided via a JavaScript SDK that you embed on your website or application.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Subscriptions and Payments

The Service offers both free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis.

All payments are processed by Paddle.com Market Limited, our Merchant of Record. Paddle handles all billing, invoicing, and payment processing. By subscribing to a paid plan, you also agree to Paddle's terms of service.

Prices are displayed in USD and may be subject to applicable taxes (VAT, GST, sales tax) which Paddle calculates and collects based on your location.

5. Refunds

Please refer to our Refund Policy for detailed information about refunds and cancellations. Refund requests are processed through Paddle.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Record sensitive personal data without proper consent from your end users
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to the Service
  • Use the Service for any illegal or unauthorized purpose
  • Transmit malware, viruses, or harmful code
  • Resell or redistribute the Service without authorization

7. Data Privacy and Compliance

You are responsible for ensuring your use of the Service complies with applicable data protection laws (including GDPR, CCPA, and others). This includes:

  • Obtaining necessary consents from your end users before recording sessions
  • Disclosing your use of session recording in your privacy policy
  • Configuring appropriate data masking for sensitive fields
  • Responding to data subject requests from your end users

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Claymore.one and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you submit through the Service. You grant us a limited license to process this data solely for providing the Service.

9. Account Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, may harm us or other users.

You may cancel your account at any time through your account settings or by contacting support. Upon cancellation, your access to the Service will continue until the end of your current billing period.

10. Limitation of Liability

To the maximum extent permitted by law, Claymore.one shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.
